This addendum is hereby incorporated into the solicitation package of the package of Request for Proposals (“RFP”) referenced above. The following items are clarifications, corrections, additions, deletions and/or revisions to and shall take precedence over the original documents.
RESPONDENT QUESTIONS:
The Museo de Arte de Ponce (“Museum”) issues this Addendum to provide responses to the questions received from prospective Respondents (slightly revised for clarity). The Museum further confirms to all interested Respondents that the Proposal Due Date remains August 15, 2022. All Proposals must be submitted on or before this deadline and consistent with the requirements set forth in the RFP.
1.The RFP scope of work includes the requirement that the selected Owner’s Representative (OR) will review and comment on architectural and engineering documents. Can the Museum confirm that it is the responsibility of the designers to certify compliance with local laws and regulations?
It is the responsibility of the design team (architects and engineers) to ensure the design complies with the local laws and regulations. The OR review is to ensure that the design conforms to the Museum’s direction for this project.
2.The RFP scope of work includes the requirement for review of the 100% DD and the 95% CD documents. Will the OR be required to complete a review of the 100% CD documents prior to bidding?
Yes, the OR will be required to review the 100% CD documents.
3.Is an OGPe inspector required? If so, with what frequency
The selected OR firm will be required to provide an OGPe inspector. The frequency of the inspections will depend on the level of construction, but at a minimum, during the construction phase, monthly inspection reports are required to be submitted to the City of Ponce.
4.The Cost Proposal form includes “Subject Matter Expert.” Please clarify in which area is this required.
The Museum requires expertise in the following areas: Design Review, Construction Review, and Project Coordination. Accordingly, the Museum includes an amended Cost Proposal Form in the present document. Respondents may include additional Subject Matter Experts needed to execute its proposed approach under “Additional Positions.”

G. COST PROPOSAL FORM
Unless otherwise indicated in this Scope of Services, all services performed under this contract shall be paid in accordance with this Price Proposal.
An authorized representative of the firm offering this proposal must complete this form in its entirety. Prices entered herein shall not be subject to withdrawal or escalation by Respondent.
MAP does not assume any responsibility that the final quantities shall remain in strict accordance with the estimated quantities, nor shall the Respondent plead misunderstanding or deception because of such estimate of quantities or of the character, location of the work, or other condition pertaining thereto.

Proponents may provide additional positions that they deem necessary to execute the scope of work included in the RFP, however, for price comparison, only these categories will be evaluated in the RFP review.
Labor rates shall include all equipment, tools, and supplies necessary for the employee to perform the tasks assigned, including any costs associated with necessary software or data management. Any other out of pocket expenses, such as travel related expenses, meal allowances, or hotel rooms shall be reimbursed at cost, with no mark-up, and must be pre-approved in writing by MAP. MAP reserves the right to select the proposal that it deems most advantageous to MAP, in its sole discretion, based on the evaluation factors as described in this RFP.
